The Presiding Judge of the Jos Judicial Division of the National Industrial Court, Hon. Justice Ibrahim Galadima, has dismissed a suit filed by disengaged staff of Jos Electricity Distribution Company in the case of Mr Aaron & 44 Others vs Jos Electricity Distribution, for lacking merit.
The claimants had sought the payment of ₦16.5 million in alleged employment entitlements, but the court held that they failed to provide credible and sufficiently particularised evidence to support their claims, which it described as special damages requiring strict proof.
According to the claimants, they were employed by Jos Electricity Distribution between 2014 and October 2017, when their appointments were terminated.
They argued that the termination amounted to a breach of their employment contracts and that the company failed to fully settle their entitlements, including salary in lieu of notice, outstanding 30% salary for September 2017, payment for 13 days worked in October 2017, and house rent allowances.
