A fight over Fortnite turned deadly when a 9-year-old grabbed a gun, leading to his brother’s fatal shooting, Florida police say.

Kelly Agar Garcia, 43, is facing second-degree murder charges after allegedly killing his 26-year-old stepson, Azareel J. Martinez, during a violent argument sparked by the child's video game use, according to Davenport police.

The incident unfolded Wednesday night when the boy became upset after his mother, Adriane Daza, told him he could no longer play Fortnite and took away his phone.

Police say the child then went into her bedroom and pulled a loaded Smith & Wesson 9mm handgun from a nightstand.

Daza and Garcia struggled with the boy to retrieve the gun and were eventually able to take it from him—but moments later, the situation escalated.
