The lawsuit, brought by Banuelos and her mother, Yesenia Lara Cooper, alleged that Summit Malibu failed to provide appropriate care, leading to her permanent physical and cognitive injuries. Summit Malibu denied any wrongdoing, arguing in court filings that Banuelos repeatedly refused medical advice, declined prescribed medications, and rejected recommendations to seek outside medical treatment, and that staff lacked authority to force her. Judicial approval was necessary for the settlement because Banuelos is unable to manage her own affairs, and the agreement was reached after her attorneys reduced their requested legal fees from $1.2 million to $1 million.
