Supreme Court: Children's court must independently decide whether juvenile should be tried as adult; failure vitiates entire trial

The Supreme Court has held that a Children's Court cannot proceed to try a child in conflict with law as an adult without first passing a reasoned order under Section 19(1) of the Juvenile Justice (Care and Protection of Children) Act, 2015. The Court ruled that this requirement is mandatory and that failure to comply with it vitiates the entire trial, regardless of whether the Juvenile Justice Board (JJB) had earlier recommended an adult trial.
