His now former wife secretly copied his staff discount details from his tablet computer and shared them, leading to the misuse between 31 October and 17 December 2024. A Workplace Relations Commission adjudicator ruled that M&S's decision to sack Mr Brennan from his 10-year employment was a "disproportionate" and "excessive" response. Mr Brennan was awarded €2,000 under the Unfair Dismissals Act 1977, reduced from €4,000 due to his "significant contribution" through carelessness. Despite M&S viewing discount abuse in "almost apocalyptic terms," the adjudicator found the dismissal excessive, noting Mr Brennan had offered to repay the €464.39 in discounts.
