U.S. Magistrate Judge Susan Hightower ruled that Musk must sit for a deposition and recommended allowing a fraud claim against him and his America PAC. The lawsuits, filed by Arizona residents Joy Harvick and Jacqueline McAferty, allege Musk misled voters by falsely advertising the giveaway as random to collect personal information. Plaintiffs cite a statement from Musk's lawyer indicating winners were chosen as potential spokespeople for America PAC, contradicting claims of randomness. U.S. District Judge Robert Pitman will now review Judge Hightower's recommendations and rule on a separate request to dismiss one of the lawsuits.
