While the man who killed Doug Battle got a life sentence, one of his accomplices is about to be executed even though he wasn't in the building.

Had the execution gone forward, Burton would have faced a harsher punishment than the man who killed the victim during a botched robbery that Burton participated in.

Charles Burton was involved in a store robbery in which his accomplice shot and killed a customer.

Alabama Gov. Kay Ivey on Tuesday commuted the death sentence of Charles "Sonny" Burton, a man who has been on death row for more than 30 years.

The Republican governor commuted the death sentence of 75-year-old Charles Lee “Sonny” Burton. Burton had been set for execution on Thursday, March 12.
