Robert Roberson, who has maintained innocence in death of two-year-old daughter, gets third execution date stayed

A Texas appeals court has granted a stay of execution for Robert Robertson, who was convicted in 2002 of the death of his 2-year-old daughter Nikki Curtis.

The Texas Court of Criminal Appeals issued the ruling on Thursday, Oct. 9, one week before Robert Roberson’s execution for the death of his 2-year-old daughter Nikki.

Robert Roberson's execution is halted under the state's "junk science" law that allows courts to re-examine convictions based on outdated science.

The Texas Court of Criminal Appeals agreed to reopen Roberson's habeas petition but did not approve a new trial.
