At Tuesday's hearing, the judge ruled that the grand jury lacked sufficient evidence for first-degree murder and terrorism charges against the 27-year-old. The remaining counts, including second-degree murder, still stand. Mangione's trial is set to begin on December 1.

Judge Gregory Carro also ruled a second-degree murder charge against Mangione could stand during a hearing on Tuesday.

Mangione is still facing second-degree murder charges in New York
