Former Beatrix mine worker disputes R254,000 provident-fund payout.

The Financial Services Tribunal has set aside a decision by the Pension Funds Adjudicator (PFA) after finding that an ex-Beatrix Mine employee's complaint about an allegedly unpaid provident fund benefit was never properly considered.

The tribunal ruled that while the PFA correctly found it had no jurisdiction over an insurer's decision to reject a disability insurance claim, it failed to determine the applicant's separate complaint that he had not been paid his full provident fund benefit.

The matter has now been sent back to the adjudicator for reconsideration.

Johannes Kgosimang Lephatsa, a former Ventilation Construction Assistant at Sibanye Gold's Beatrix Mine, approached the tribunal after the PFA closed his complaint in March 2026.
