A US appeals court has ruled that a Wisconsin man cannot be prosecuted for privately possessing AI-generated images depicting child sexual abuse.
A US appeals court has upheld the dismissal of a possession charge against a Wisconsin man accused of creating and storing thousands of AI-generated images depicting minors in sexually explicit situations.
The Seventh Circuit Court of Appeals ruled that Steven Anderegg, 44, could not be prosecuted for privately possessing the AI-generated images because they did not involve real children.
The ruling was based on existing US Supreme Court precedent concerning the private possession of obscene material and fictional depictions of children.
The court's decision applies within the Seventh Circuit, which covers Illinois, Indiana and Wisconsin.
