Judge Connie Prinsloo found that the Labour Court lacked jurisdiction to hear the matter and that Khan had failed to establish urgency, clearing the way for SAPS to continue with the disciplinary proceedings

Judge Prinsloo held that the Labour Court does not have a general power to intervene in ongoing disciplinary hearings unless a specific statutory provision confers such jurisdiction. She found that Khan's attempt to frame the dispute as a contractual claim could not overcome this limitation.
