The Justice Department filed a 20-page brief arguing that AI training on copyrighted material constitutes fair use

The Trump administration filed a brief in Manhattan federal court on Tuesday siding with OpenAI in its copyright dispute with The New York Times, arguing that training large language models on copyrighted material generally constitutes fair use.
According to Reuters, it marks the first instance of the U.S. government stepping into the growing wave of copyright litigation — filed by authors, publishers, music labels, and news outlets — over the use of their work to train AI systems. Although such a filing carries no binding legal authority, it may lend additional support to tech companies contesting these claims in court.
