Labour Court upholds dismissal of former SAHRC CFO over offensive email.

The Labour Court in Johannesburg has dismissed a review application by former South African Human Rights Commission (SAHRC) Chief Financial Officer Petrus Makaneta, confirming that his 2019 dismissal for misconduct was fair

Acting Judge B. Ramji dismissed Petrus Makaneta's review application, concluding that the CCMA commissioner had not committed any reviewable irregularities and that the arbitration award finding his dismissal substantively and procedurally fair was reasonable.

The dispute arose after SAHRC commissioner André Gaum was invited to Australia for a conference in November 2018.

Gaum forwarded the invitation to all other commissioners seeking their agreement to him attending the conference. He stated in the e-mail that the chairperson advised that there was money available for the trip, and that he should consider whether he should ‘fly business class due to the long haul.’
