NAVR Backs Legal Challenge to California Law Restricting Veterans’ Right to Choose

The National Association for Veterans Rights (NAVR) today welcomed a federal challenge to California Senate Bill 694 (SB 694), saying the case underscores a principle NAVR has consistently championed: Veterans deserve strong consumer protections without sacrificing their freedom to choose how they pursue the benefits they earned.

Veteran Benefits Guide, Veterans Guardian, and two California Veterans filed suit in the U.S. District Court for the Southern District of California challenging SB 694, which is scheduled to take effect January 1, 2027. The federal challenge seeks to stop the law from taking effect, arguing the law would strip California Veterans of the freedom to choose trusted, independent assistance in pursuing the disability benefits they earned.

The lawsuit raises significant constitutional and federal-law questions, alleging that SB 694 violates First Amendment rights involving speech, association, and the right to petition the government. It also argues the law conflicts with Congress’s 2006 decision to repeal a previous federal blanket prohibition on compensated claims assistance.

“This case is about something much larger than any one company or business model,” said Peter O’Rourke, President of NAVR. “It is about whether Veterans retain the right to make informed decisions about how they pursue the benefits they earned. We can protect Veterans from bad actors through strong standards, transparency, reasonable fee limitations and meaningful enforcement without eliminating legitimate choices altogether.”
