Mpumalanga health department found liable for child's cerebral palsy due to birth injury.

The Mpumalanga Department of Health has been held fully liable for the damages suffered by a child who sustained a brain injury during his birth at Piet Retief Hospital in 2009.

The High Court in Mbombela found that inadequate foetal monitoring during labour amounted to negligence and caused the child's cerebral palsy.

Acting Judge President Takalani Vincent Ratshibvumo ruled in a claim brought by the child's mother against the MEC of Health in Mpumalanga.

The mother sued both in her personal capacity and on behalf of her son, who was born in November 2009.
