Legal battle leads to attorney's removal from managing R8.48 million estate.
A Cape Town attorney has been removed as the executrix of her late sister’s R8.48 million estate by the Western Cape High Court, which found she misused estate funds for personal legal battles.
The high court also barred her from serving as trustee of a testamentary trust for her late sister’s minor twin children, citing a conflict between her personal interests and fiduciary duties. This decision followed an application by the twins' father, aimed at safeguarding their rights as primary beneficiaries.
Acting Judge M Louw ordered the attorney’s removal after an application was brought by the father of the twins, who sought to protect their interests as the principal beneficiaries of the estate.
The attorney, who was the deceased's identical twin sister, maternal aunt, godmother to the children, and a beneficiary of the estate, was nominated in her sister's will to serve as trustee of the testamentary trust for the twins.
