Observing that there ‘was an utter failure of effective administration on the part of HYDRAA Commissioner and the Revenue authorities’ in the demolition of compound wall of a property in Kondapur in Hyderabad, the Telangana High Court on Thursday instructed them to file a counter affidavit within a week in the matter. Justice N.V. Shravan Kumar of the HC, hearing a writ petition filed by a housewife Pemmasani Sudha Rani seeking to declare ‘compound wall demolition by HYDRAA’ as illegal, said there “is no coordination between” the HYDRAA and the Revenue department. “They are misleading and misdirecting themselves, thereby bypassing the orders passed by this court,” the judge noted. Such actions affected the petitioner, he said. The judge also observed that it was trite law that officials “have to follow provision of the Telangana Land Encroachment Act-1905 even in matters where constructions/encroachments were made on government land”. In the case on hand, the authorities should not have demolished the compound wall without issuing notices to the petitioner, the judge said. In 2022, the HC disposed of a writ petition filed by the petitioner permitting the latter to construct compound wall around the 350 square yards plot. The authorities were at liberty to take appropriate action by issuing notices if the compound wall construction went beyond the property. The Serilingampally Tahsildar, present in the court, informed the bench details of the order were communicated to the Revenue higher officials, who in turn, passed on the same to the police. The Tahsildar confirmed that there was no specific communication from the Revenue department to HYDRAA Commissioner to demolish the petitioner’s compound wall. The HYDRAA counsel, however, maintained that the agency was not informed about the HC orders issued in 2022. “Now, from the entire gamut of the events, it is crystal clear that there is no coordination between the Revenue department and HYDRAA in so far as carrying out demolition is concerned,” the judge noted. He directed the Tahsildar to appear before the bench on all days of the hearings of the plea which was adjourned to August 6. Published - July 30, 2026 09:46 pm IST
