Actor Ansiba Hassan has approached the Kerala High Court aggrieved by an order of the Judicial First Class Magistrate Court, Ernakulam, refusing to register a case on her complaint against a video allegedly containing sexually coloured and defamatory statements made by another actor, Lakshmipriya. Ms. Hassan also sought directives to the Magistrate to direct the police to register an FIR based on her complaint and conduct a fair and impartial investigation.The plea contended that the Magistrate had committed an error in concluding that Ms. Hassan’s allegations only disclosed the offence of defamation and disregarded her grievance that the accused in her complaint had deliberately outraged her modesty by publishing sexually coloured remarks through social media. She pointed out that whether an act amounted to outraging the modesty of woman could not be determined by the opinion of the police or the Magistrate at the pre-investigation stage under the law. Ms. Hassan alleged that in the early hours of June 26, a teaser video of an interview with actor Lakshmipriya was published on a social media platform, containing sexually coloured remarks intended to outrage her modesty and insult her dignity as a woman. Reportedly, Ms. Hassan attempted to prevent the release of the full interview by making a complaint to the Station House Officer, Palarivattom police station. Later, alleging inaction on the part of the police, she preferred a complaint to the Home Minister, who reportedly informed her that an investigation was already under way. However, Ms. Hassan stated that on the evening of June 26, the full interview was released. It is stated that, thereafter, Ms. Hassan submitted a written complaint before the SHO, Palarivattom police station, requesting immediate legal action. On June 27, the accused social media platform published another video containing further allegedly defamatory remarks, causing a fresh affront.
