The trial-within-a-trial into the admissibility of evidence obtained during the arrest of accused number one, Musa Kekana is set to continue in the Johannesburg High Court on Tuesday as the trial of alleged cartel member Vusimuzi “Cat” Matlala resumes.
The hearing, held within the main trial, will determine whether evidence gathered by police following Kekana’s arrest on April 17, 2024 can be used against him.
Kekana’s legal team has argued that the arrest was unlawful, that his constitutional rights were not explained to him and that subsequent searches were conducted without a warrant.
The State is seeking to prove that statements and other evidence obtained during and after Kekana’s arrest are admissible.
