People’s National Movement (PNM) General Secretary Foster Cummings has been served with a court order compelling that the party provide financial and other records to explain the funding of the multimillion-dollar construction of Balisier House in Port of Spain.The Express understands that since last Friday police have been trying to serve the court order unsuccessfully and were only able to serve Cummings around 12.15 a.m. yesterday at Piarco International Airport as he returned from a trip abroad.Sources said two Special Branch officers took Cummings aside and informed him of the service which he accepted and signed for receiving.The Express understands that on Tuesday two police constables went to Balisier House and requested information relating to the trustees of Balisier House and other details concerning its management.They were informed that Cummings was not in office at the time and were directed instead to PNM chairman Marvin Gonzales.Opposition Leader Pennelope Beckles is currently out of the country.Last Friday, High Court Judge Margaret Mohammed granted an order to the Trinidad and Tobago Police Service (TTPS) requiring the PNM to explain the funding for the multimillion-dollar construction of its Balisier House headquarters in Port of Spain.The police were given seven days to serve the order.Police have been investigating the construction of Balisier House and, on July 10, 2026, Commissioner of Police Allister Guevarro, who appointed Acting Assistant Commissioner of Police Ramdath Phillip to lead the investigation, authorised him to make an application in the High Court for a Preliminary Unexplained Wealth Order (PUWO) in accordance with Section 58(1) of the Civil Asset Recovery and Management and Unexplained Wealth Act, 2019.The application for the PUWO against the PNM and the party’s trustees was subsequently submitted to the High Court.The application names the trustees of the PNM as the first respondent and the PNM, represented by its general secretary, as the second respondent.The matter is listed as an ex parte application brought by the Commissioner of Police pursuant to Section 58(1) of the act, with Ramdath Phillip acting as the applicant in the proceedings.Specified offenceIn the filing, ASP Phillip stated that investigators identified property during the course of an investigation into what he described only as a “specified offence”.The application alleged there are reasonable grounds to suspect that:• the total wealth of the respondents exceeds the value of their lawfully obtained wealth• the total wealth of the respondents exceeds $500,000• the property in question is owned by the respondents or is under their effective control• the property was obtained through the commission of a specified offence.The police are asking the court to compel the PNM and its trustees to file declarations and answer questions relating to their assets and wealth.A Preliminary Unexplained Wealth Order is an investigative mechanism under the Civil Asset Recovery and Management and Unexplained Wealth Act which allows authorities, with the approval of the court, to require individuals or entities to explain the origin of assets where there are reasonable grounds to suspect that the wealth was derived from unlawful conduct.The application was signed by ASP Phillip on July 10, 2026, and was stamped by the High Court on the same date before Justice of the Peace Kimberly Prescott.The document indicates that the Commissioner of Police is represented by King’s Counsel Anthony Peto KC and junior counsel Thomas Cleaver of Blackstone Chambers in London, with attorney Dayadai Harripaul serving as instructing attorney.Gonzales has described the police action as a political witch-hunt.
