A wife tried to stop her husband's pension benefits because he didn't pay the maintenance ordered by the family court. However, the Madras High Court dismissed her plea, by holding that maintenance orders must be enforced through proper execution proceedings and not through a writ petition.This ruling (case no. W.P.(MD) No.14786 of 2026, dated June 4, 2026) was made in the context of a failed marriage between a wife and an employee of the Tamil Nadu State Transport Corporation (TNSTC). She had filed several legal cases against him in both the family court and the civil court, eventually securing an order directing him to pay her monthly maintenance.He however, for reasons best known to him, did not comply with the court order and did not pay the maintenance. Since he didn't compy with these orders, the wife moved the Madras High Court, asking for directions to the Administrator of Tamil Nadu State Transport Corporation Employees Pension Fund Trust and the General Manager of Tamil Nadu State Transport Corporation (KUM) Ltd, to stop his pension payments.Why did she lose the case?Advocate Mayank Arora, Partner, The Chambers of Bharat Chugh, said to ET Wealth Online: This Madras High Court’s judgement is a reminder of the limits of writ jurisdiction, even in cases where the underlying grievance may appear sympathetic.In this case, the petitioner-wife approached the Madurai Bench of the Madras High Court under Article 226 of the Constitution, seeking a writ of mandamus against the Tamil Nadu State Transport Corporation Employees Pension Fund Trust and the Corporation, asking them not to disburse pensionary and other service benefits to her husband. Her case was that her husband had failed to honour maintenance payment and therefore his terminal benefits should be stopped from being released to him.Arora says that the Madras High Court, however declined to entertain the writ petition. The Hon’ble court reiterated the legal principles stating that awrit petition is not meant to convert the High Court into an executing court or a Family Court. Writ jurisdiction is primarily invoked when there is infringement of a legal or fundamental right by the State or its instrumentalities, and where the petitioner does not have an equally efficacious alternative remedy. In the present case, the wife’s grievance was essentially against her husband, not against the State Transport Corporation or the Pension Fund Trust. There was no legal or constitutional right of hers that had been infringed by those authorities. The authorities were merely required to disburse pensionary benefits in accordance with law.According to Arora, the high court therefore held that if the petitioner had succeeded in obtaining maintenance orders, her remedy was to initiate execution proceedings or other appropriate proceedings for enforcement of those orders. The High Court could not be used as a shortcut to enforce a private matrimonial or maintenance dispute by restraining a public authority from releasing pensionary dues.Madras High Court order and discussionThe Madras High Court said that after carefully considering her submissions and reviewing the material on record, it was of the opinion that she had chosen the wrong court to file this case.The Madras High Court said that the writ petition seeking relief as noted above cannot be entertained, as the Court cannot be converted into an Execution Court or a Family Court for resolving disputes between wife and husband. The high court said that if she succeeded in the maintenance case against him, it is for her to initiate execution proceedings or otherwise for execution of the said orders. But, under no circumstances, she can be allowed to maintain the present writ petition either for execution of the orders passed in the maintenance case or to resolve the dispute between them.Going with this reasoning, the Madras High Court said there is no legal or constitutional right that is infringed and her grievance is only against him. Therefore, Madras High Court said that her writ petition is not maintainable. The high court made it clear that she can pursue her rights and any other issues brought up in this writ petition by initiating the appropriate legal actions before the appropriate forum.
