Jay Clayton, President Donald Trump’s nominee to become the nation’s top intelligence chief, repeatedly declined to say who won the 2020 presidential election during Wednesday’s Senate confirmation hearing, prompting sharp rebuke from Sen. Jon Ossoff (D-Ga.).“Who won the 2020 election?” Ossoff asked.“I’m not going to do this with you,” Clayton replied.“This is a job interview,” Ossoff continued. “You have an obligation to be honest and forthright with the committee, yes?”“Like I said, I’m not gonna get into that with you,” Clayton said.As Ossoff pressed him again, saying he was “not being honest,” Clayton sidestepped the question and then sat in silence, leading to a standoff.“You refuse to answer a basic question about who won a presidential election, but you ask to lead America’s intelligence community?” Ossoff said. “Isn’t it humiliating to be unable to answer this question? To have to indulge the president’s delusions?”Clayton again did not respond to that question.Throughout the hearing, senators from both parties raised concerns about Clayton’s fitness to lead the nation’s intelligence community. Lawmakers on the Senate Intelligence Committee grilled Clayton about the recent subpoenas he signed off on of New York Times’ journalists, as well as his lack of intelligence or national security experience.Clayton also faced broader questions about his independence from a president who has shown a willingness to target perceived political adversaries and amplify election fraud claims. Highly scrutinized was Clayton’s refusal to affirm that Joe Biden won the 2020 election. When Sen. Angus King (I-Maine) asked him who won the 2020 presidential election, Clayton declined to answer directly, deferring to the response he gave on a similar question from Sen. Mark Warner (D-Va.) earlier in the hearing.“I am not an election denier. Joe Biden was certified as the president. He went through his process. We went through our electoral process,” Clayton said.“I’m just asking a really simple question. Who won the 2020 election?” King repeated.“As I said to you, we went through our processes, and Joe Biden became the president of the United States,” Clayton responded.“That’s not an answer to the question,” King said.“I think, I think I’ve answered it many times,” Clayton said.“You have not answered it ... saying ‘Joe Biden was certified’ is not an answer,” King said.Warner, who serves as vice chairman of the committee, expressed disappointment during closing remarks on how Clayton refused to acknowledge Biden specifically won the election.“I’ve known Mr. Clayton for some time... but I am bitterly disappointed. We’ve tried umpteenth different ways to gift you the ability to just acknowledge the Joe Biden was the president,” he said.“I’ve acknowledged that Joe Biden was the president,” Clayton responded.Warner continued, “...and fairly and duly elected.”Clayton added: “...and fairly and duly elected, under our process.”
