A judge has lashed police for accusing a French tourist of killing someone when he crashed into Sydney’s Hyde Park fountain, telling a court there was “not a scintilla of evidence”.The young man has been left homeless in Sydney and unable to return home to France or get a job as a result of the charge as police seized his identity documents.Eizeur Kouki, 23, reversed into the fountain while he was delivering an Uber Eats order on June 3.He was initially charged with negligent driving occasioning death among a series of other charges, however, prosecutors on Wednesday withdrew the charge which a local judge said “was laid without any factual basis at all by the police”. “(I am) somewhat perplexed as to why this young man was charged (with occasioning death) … when there is absolutely not a scintilla of evidence to suggest that that was ever the case,” the judge told the Downing Centre Local Court on Wednesday.The man was fined and convicted of negligent driving, not reversing safely and driving without a NSW licence.He told reporters outside court he was “very sorry” and keen to return home to France.He later yelled “Thank you, Australia” out of the sunroof of a car he was driven away from court from.More to comeRead related topics:Sydney
