The legal battle over matric results continues as Information Regulator appeals ruling

The Information Regulator has applied directly to the Supreme Court of Appeal for leave to appeal a full bench ruling that found matric results may legally be published on public platforms.

The legal battle over publishing matric results in newspapers and online is far from over.

The Information Regulator (IR) has applied directly to the Supreme Court of Appeal (SCA) for leave to appeal a full bench ruling that found matric results may legally be published on public platforms. That judgment was won by AfriForum and other parties.

The Gauteng High Court, Pretoria, last month dismissed the IR's application for leave to appeal. While the SCA must still decide whether or not to entertain the application for direct access to it, AfriForum said it would oppose this attempt as well.

“Relief that the dispute over the publication of matric results has finally been resolved was short-lived. It is clear that the IR neither recognises the futility of this case nor understands the risks that a ruling in its favour would pose,” Alana Bailey, AfriForum’s Head of Cultural Affairs said.
