A moratorium against data centers in Kentucky is being challenged by a developer in court that is looking to build a gigawatt-scale campus.Kentucky Industrial Alliance LLC has filed a lawsuit against the City of Cave City, Cave City Council, and the city-county planning commission of Barren County, according to a complaint filed June 8.In May, real estate firm Kentucky Industrial Alliance quietly submitted plans for a data center project on 380 acres of largely undeveloped and industrial-zoned land at 2001 Doyle Avenue.However, Cave City implemented a 12-month moratorium on data centers later that month. Plans for the data center were not public at the time.News of the project was first publicly revealed via the complaint. Local press reports, however, stated that the Cave Point Commerce Center would have seen some ten buildings totaling 2 million sq ft (185,806 sqm) and up to 1.2GW of capacity potentially planned on the site. Kentucky Industrial had been working through the Cave City DataCo I LLC affiliate.In the complaint, Kentucky Industrial calls the moratorium “unlawful” and is requesting an injunction to lift the ban.The case is due to be heard in July.In a statement to local press, Kentucky Industrial said: “Property owners, businesses, and developers routinely rely upon existing zoning regulations when making significant financial investments. Our intent has always been to comply with applicable laws, follow established procedures, and work within the framework that existed before this project was proposed. Kentucky Industrial Alliance LLC remains committed to working through established regulatory and review processes while providing accurate information to the public. We believe important decisions should be based on facts, engineering, science, and applicable regulations rather than rumors or misinformation.”Owned by Mike Jones, Jared Whitworth, and Joey Crist, Kentucky Industrial Alliance LLC collectively owns, operates, or leases more than 4,000 acres of agricultural land.
