A pensioner has successfully regained ownership of his property after the Western Cape High Court ruled that his daughter breached their sale agreement.
A 77-year-old man from Cape Town, has regained ownership of his home following a ruling by the Western Cape High Court.
The court determined that his daughter did not pay the agreed R650,000 for the property and dismissed her claim that he lacked mental capacity due to dementia during the transaction.
Acting Judge Yake ordered the property to be returned to owner, Mr Fredericks, citing the daughter's failure to honour the sale agreement.
“It is indeed unfortunate that this dispute arises within the context of family relations, for courts have consistently emphasised that such conflicts are best resolved outside of litigation, so as to avoid further strain upon familial bonds,” Yake wrote.
