TWO police officers who were charged in 2014 with misbehaviour in public office have had the corruption allegations against them dismissed after prosecutors indicated they would not be proceeding with the case.On Monday, PCs Selvon Joseph and Samuel Gardiner were discharged during a sufficiency hearing before High Court Master Nazeera Ali.The charges arose out of an incident in February 2014, when it was alleged that Joseph, Gardiner and another police officer had agreed to accept $15,000 from a man in Chaguanas in exchange for not pursuing criminal proceedings against him.Court records indicated the arrangement allegedly took place along the Chaguanas Main Road and involved Kerry Rambaran, who was identified as the complainant in the matter. However, the case later suffered a setback following Rambaran’s death while the proceedings were still before the courts. In an attempt to keep the matter alive, the State had previously sought to rely on a statement Rambaran had given to investigators prior to his death, invoking provisions of the Evidence Act.During earlier hearings, attorneys Roshni Balkaran-Boodoo and Shiva Boodoo, who represented Joseph, questioned whether it was a proper use of judicial resources to continue pursuing a case that was already 12 years old and whose key witness was no longer alive. When the matter was called before Master Ali on Monday, prosecutors informed the court that they would be offering no evidence against either Joseph or Gardiner, effectively bringing the proceedings to an end.Balkaran-Boodoo and Senior Counsel Keith Scotland, who appeared on behalf of Joseph and Gardiner, respectively, welcomed the outcome and commended the prosecution for its decision to have the matters discontinued.Attorney Shellini Ramdeen appeared on behalf of the Office of the Director of Public Prosecutions (DPP).
