The Administrative Plenary of the Supreme Court has rejected an appeal by the European Public Prosecutor’s Office (EPPO) against the limited renewal of the mandates of three delegated European prosecutors as inadmissible.
The EPPO insists that three prosecutors serving in the Greek division of the office should be given a five-year renewal term instead of the two-year extension they received in May, but the request was rejected with 72 votes versus only 10 in favor.
Kathimerini understands that the appeal was rejected on the grounds that Greek legislation provides that only judicial officers themselves may appeal to the Administrative Plenary of the Supreme Court regarding matters relating to their terms.
Therefore, the EPPO’s request was deemed inadmissible, as it did not have the right to appeal on behalf of the three prosecutors.
The EPPO was represented by constitutional scholar Spyros Vlachopoulos, who submitted a memorandum noting, among other things, the primacy of EU law in this specific case.
