In a landmark legal decision, a high court judge has ordered that the Newcastle Municipality compensate local business owners whose operations were shut down due to an unsubstantiated interdict.
The plaintiffs - Newcastle Industrial Launders CC, Faizel Cassim, RF Screen Printers (PTY) LTD, and Roelien Andie Venter - brought the application in the Pietermaritzburg High Court, suing the municipality for R18,6 million in damages.
Cassim is the owner and managing director of Newcastle Industrial Launders, and Venter holds a 50% share and is the managing director of RF Screen Printers.
According to the court papers, both businesses consumed electricity, water and other services, including sewage and industrial waste disposal, supplied by the municipality.
