Observing that ‘enhancement of the age of superannuation is the prerogative of the State government’, the Telangana High Court dismissed a batch of writ petitions filed by some teaching faculty members of the Professor Jayashankar Telangana State Agricultural University and P.V. Narasimha Rao Telangana Veterinary University questioning the proceedings issued by the government fixing retirement age at 60 years. Justice K. Sarath, pronouncing verdict in the batch of pleas, said the contentions raised by the petitioners were devoid of merits. Citing some verdicts of the Supreme Court, the judge said ‘superannuation is a matter of policy and it is not within the domain of the court to legislate’. He also observed that the question of age of retirement stands on a different footing from the service conditions relating to pay and allowances.The judge did not agree with the contentions of the petitioners that they were receiving University Grants Commission pay scales on par with other teaching faculty of the State government universities under the control of Higher Education department and hence it was a ground for enhancement of superannuation age. The two universities the petitioners working for were under the administrative control of the department of Agriculture and Cooperation and Animal Husbandry, Dairy Development and Fisheries.
