New Delhi: A Congress delegation on Wednesday urged ECI to reinstate the nomination of the party's Rajya Sabha nominee in Madhya Pradesh, Meenakshi Natarajan. The party's lawyer-parliamentarian Abhishek Singhvi argued the returning officer's decision a day earlier to reject her papers, on account of "non-disclosure" of a case against her, was "perverse" as it was in violation of Section 33A of the Representation of the People's Act, which mandates disclosure only in cases where charges have been formally framed by a court and where the alleged offence carries a punishment of more than two years. He pointed out that the court had not even taken cognisance of the case against Natarajan.Detailing the line of defence the party delegation presented before the election commissioners, Singhvi said, "Ms (Meenakshi) Natarajan only received a notice to appear before the court and explain why cognisance should not be taken. That means the notice was issued before any cognisance was taken. Without cognisance, no criminal case exists in the eyes of the law." The returning officer had rejected Natarajan's papers by citing non-disclosure of the pending court case against her.
