The Pietermaritzburg High Court dismissed the appeal of man who claims he was unlawfully detained by police in 2016.

A man who claimed he was unlawfully detained by police at the Durban Central police station and assaulted while in custody has failed in his attempt to sue the police after the Pietermaritzburg High Court dismissed his appeal.

Gabriel Hlongwane was arrested on April 29, 2016, by private security officer Jacob Machaka, who suspected him of being part of a syndicate targeting bank customers by swapping their bank cards while they used automated teller machines (ATMs).

According to Machaka, Hlongwane had been on the company’s watchlist. The arrest took place at the First National Bank branch in Greyville, Durban.

After arresting Hlongwane, Machaka, who worked for Black Dolphin Investigations, handed him over to the police, who detained him at the Durban Central police station over the long weekend until May 3.
