In the wake of a veteran Toronto Crown attorney telling the defence that key video evidence from a drug-related impaired driving case didn’t exist when, in fact, it did, the Criminal Lawyers’ Association is calling for a review to determine if other cases may have been impacted.
At issue are video recordings of what is known as a drug recognition evaluation (DRE), where a specialized officer assesses through a series of tests whether the person is impaired by drugs, to determine whether police are in a legal position to demand a urine sample.
