Two Auckland real estate licensees have been ordered to pay $26,486 in compensation after failing to disclose structural defects that left the purchasers with a leaking home.

A Real Estate Agents Disciplinary Tribunal decision released on May 20, 2026, revealed that Shane Coote and Andrew John Miller, also known as Drew Miller, had actual knowledge of the property’s defects from building reports but failed to alert the buyers.

The purchasers, identified in the decision as DG and NC, bought the North Shore residential property in July 2019 for $785,000. Within a month of moving in, water began tracking through the roof and leaking under and through the windows.

The Real Estate Agents Authority’s Complaints Assessment Committee previously found both licensees guilty of unsatisfactory conduct for breaching professional conduct rules. The committee ordered Coote to pay a fine of $2500 and Miller to pay a fine of $750 plus undergo training, before referring the claim for compensation to the disciplinary tribunal.

According to the tribunal’s decision, the vendor had obtained building reports before the sale that identified a moderate weathertightness risk due to insufficient flashings around the joinery in multiple areas.
