Harvey Weinstein's third trial over allegations he used his Hollywood power to sexually abuse women ended in a mistrial on Friday after jurors failed to reach a unanimous verdict on a rape charge involving aspiring actress Jessica Mann. The disgraced former movie mogul, 74, will remain behind bars due to separate convictions already secured against him in New York and California.Weinstein, once one of Hollywood's most influential producers and the co-founder of Miramax, saw his career and reputation collapse after a wave of sexual misconduct allegations emerged in 2017.The accusations against him became a defining catalyst for the global #MeToo movement, encouraging women around the world to speak publicly about abuse and misconduct at the hands of powerful men.The latest retrial centred on claims made by Mann, who alleged that Weinstein raped her in a Manhattan hotel room in 2013 while she resisted and repeatedly said 'No'.Weinstein denied the allegations and pleaded not guilty to one count of third-degree rape. His legal team argued the encounter was consensual and claimed Mann later fabricated the accusation after becoming upset that her relationship with Weinstein failed to help her acting career.Jurors spent three days deliberating before informing Justice Curtis Farber on Friday that they were unable to reach a unanimous decision. Harvey Weinstein's third trial over allegations he used his Hollywood power to sexually abuse women ended in a mistrial on Friday Jurors failed to reach a unanimous verdict on a rape charge involving aspiring actress Jessica Mann Former Hollywood film producer Harvey Weinstein's attorney Marc Agnifilo exits the courthouse after the retrial of Weinstein's rape case ended in a mistrial, at Manhattan Criminal Court in New York City, May 15, 2026The judge initially instructed jurors to continue trying to reach a verdict. However, speaking outside the presence of the jury, Farber later concluded they were 'hopelessly deadlocked' and said there was no reason to keep deliberations going any longer. He formally declared a mistrial on the rape charge and instructed lawyers for both sides to return to court for a hearing on June 25.It remains unclear whether Manhattan prosecutors will attempt to try Weinstein for a fourth time over the allegation involving Mann.Manhattan District Attorney Alvin Bragg, whose office prosecuted the case, said prosecutors were disappointed by the outcome but respected the jury process. 'We will consider our next steps in consultation with Ms Mann,' Bragg said in a statement issued after the mistrial was declared.Following the mistrial, Mann said in a statement: 'Today's decision to declare a mistrial doesn't in any way detract from the truth I told and the violent crimes Harvey Weinstein committed upon me and so many others. 'I chose to testify in three trials because I am telling the truth.'For years I have had to relive some of the hardest moments of my life while facing attempts to shame, humiliate and discredit me in open court. 'I submitted myself to the highest standards, transparency, and accountability in coming forward through the justice system - choosing integrity even when the process flayed me open.'The power of predators remains too great. I deserve justice, which is why I stand up and face unbearable public scrutiny in the name of a greater good - a world where predators are not in power.'The case marks another dramatic chapter in the three-year-long legal battle surrounding Weinstein, whose prosecutions became one of the most closely watched consequences of the #MeToo era.At Weinstein's first New York trial in 2020, jurors convicted him of raping Mann and sexually assaulting former production assistant Miriam Haley in 2006.He was sentenced to 23 years in prison. But in a shock reversal last year, New York's highest court overturned the conviction, ruling Weinstein had not received a fair trial because prosecutors were allowed to call witnesses whose allegations were not directly tied to the charges he faced. The decision paved the way for the retrial that began in April.During the retrial, prosecutors again accused Weinstein of exploiting his immense influence in the entertainment industry to prey on vulnerable women seeking careers in film and television.A Manhattan jury in June 2025 convicted Weinstein of sexually abusing Haley but acquitted him of assaulting former model Kaja Sokola.Jurors, however, were unable to reach an agreement on the separate third-degree rape charge involving Mann, ultimately leading to Friday's mistrial ruling.Weinstein continues to face significant prison time regardless of the deadlocked verdict. He was separately convicted of rape in California in 2022 and sentenced to 16 years in prison in that case. Weinstein is currently appealing both the conviction and sentence. In New York, he faces up to 25 years in prison when he is sentenced for sexually abusing Haley.
