The Madras High Court, on Tuesday (April 21, 2026), dismissed a case filed by Hatsun Agro Product Limited, the owners of the popular dairy brand ‘Arokya’, to restrain Patanjali Biscuits Private Limited from selling biscuits under the brand name ‘Patanjali Aarogya’.
A Division Bench of Justices P. Velmurugan and K. Govindarajan Thilakavadi rejected an original side appeal filed by Hatsun in 2020 against the summary dismissal of its trademark infringement suit, against Patanjali, by a single judge of the High Court on February 7, 2020.
In its plaint, Hatsun had claimed to be one of the country’s largest private dairy products manufacturer. It was engaged in the sale of milk, ice creams, dairy whitener, skimmed milk powder, ghee, butter, cooking batter, varieties of curd, panneer and butter milk.
The products were marketed through brands such as Arun, Hatsun, Arokya and Ibaco. They were also exported to 32 countries and the company had built a very high and enviable reputation and goodwill for the products marketed under the trademark Arokya since 1994, it said.
Further, stating that it vigilantly protects the trademark from infringement, the plaintiff company said, that in June 2016, it came across the sale of biscuits under the brand name of Patanjali Aarogya and hence chose to file the suit before the High Court for infringement and passing off.
