Dec. 17 (UPI) -- Former special counsel Jack Smith told lawmakers Wednesday that the decision to charge President Donald Trump rested with him, and he would charge him again if presented with the same evidence.

Smith made the comments during a hearing of the House Judiciary Committee, which is investigating the Biden administration's attempts to prosecute Trump. The panel subpoenaed him for a closed-door deposition.

"The decision to bring charges against President Trump was mine, but the basis for those charges rests entirely with President Trump and his actions, as alleged in the indictments returned by grand juries in two different districts," Smith said in prepared remarks viewed by The Hill and CNN.

"If asked whether to prosecute a former president based on the same facts today, I would do so regardless of whether the president was a Republican or Democrat.
