A BMW driver accused of killing a man and seriously injuring his nine-year-old son while allegedly racing his brother has claimed he lost control of his car when he drove 'on mud'.
Abubakr Yusaf, 30, an optometrist from Manchester, allegedly crashed head-on into Rhys Jenkins while racing 34-year-old brother Umar Yusaf on the A483 near Welshpool, on November 16.
Mr Jenkins, 41, a rugby referee from Powys, died while his son Ioan, nine, was seriously injured and taken by air ambulance to Alder Hey children's hospital.
Prosecuting barrister John Philpotts, citing a witness, said the brothers were driving at around 70mph, and the BMW driver was to 'desperate' to overtake a van before causing 'catastrophic damage' with the crash.
The two cars had reached a straight stretch of road when the BMW began to 'fishtail', moving from side to side, Mr Philpotts added.
