Sean Combs’s defense team fought to keep a juror who had given multiple inconsistent statements about where he lives.
Defense attorney Xavier Donaldson said he did not believe juror number 6’s contradictory answers to be significant enough to warrant a dismissal, and that splitting time between New York and New Jersey was a “very common thing” among local residents.
“I think that [a diverse jury] is of paramount importance,” Donaldson told the judge. (Juror number 6 is a 41-year-old Black man.)
Judge Arun Subramanian expressed his concern that a fair and impartial trial would be “compromised” if the juror remained. However, he did appear to leave some wiggle room to change his mind. “If I think it’s warranted to bring the juror back to have a discussion. I’ll let you know,” he said.
