The Kerala High Court has observed that correction of date of birth of a government employee in her passport need not be preceded by correction in her service records.
The court made the observation recently while disposing of a petition filed by Josna Raphael Poovathingal of Thrissur seeking a directive to the Regional Passport Officer, Kochi, to reissue a passport to the petitioner by correcting her date of birth based on her birth certificate. The passport authorities refused to correct her date of birth on the ground that the date of birth in the passport can be corrected only after making corrections in her service records.
The court observed that in the absence of any statutory provision indicating that the correction of date of birth in the passport will have to be preceded by the correction of date of birth in the service records in case of government servants, the stand of the respondents has to be rejected. The court directed the passport officer to consider in two weeks the application without insisting on the correction of her service records.
